Terms of Service

Please read these Terms & Conditions ("Terms", "Terms & Conditions") carefully before using the JoinOurDay – Wedding Planner & Gallery mobile application (the "Service", "App") operated by JOINOURDAY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ ("us", "we", or "our"), a company registered in Poland.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. ACCOUNTS

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service (Firebase Authentication).

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You must meet the minimum age requirements as stated in our Privacy Policy (16 for EU/UK, 13 for US) to create an account and use the Service.

2. USER-GENERATED CONTENT (MEDIA)

Our Service allows you (event organisers and guests) to post, link, store, share and otherwise make available certain information, text, graphics, videos, audio, or other material ("User-Generated Media").

A. MEDIA VISIBILITY AND SHARING:

Guests can log in and upload User-Generated Media to a shared event album. By uploading User-Generated Media, guests agree that their media will be visible to all attendees of that specific event.

B. ORGANISER'S LICENSE:

By uploading User-Generated Media to an event, you (the guest) grant the event organiser(s) of that specific event a non-exclusive, worldwide, royalty-free license to download, copy, modify, distribute, display, perform, and otherwise use the User-Generated Media for their personal, non-commercial purposes (e.g., creating a personal photo gallery link, sharing on personal social media, creating a photo book, or a highlight reel from the wedding). This license continues even if you stop using our Services, unless the media is deleted.

C. YOUR RESPONSIBILITIES:

You are solely responsible for the User-Generated Media that you post on or through the Service, including its legality, reliability, and appropriateness. You represent and warrant that:

• You own the User-Generated Media or you have the right to use it and grant us and the event organiser the rights and license as provided in these Terms;
• The posting of your User-Generated Media on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity;
• You have obtained explicit consent from any and all identifiable individuals in the User-Generated Media to share their likeness as part of the media and for it to be used in accordance with these Terms;
• You consent to the use of your own likeness if you appear in the User-Generated Media you upload.

3. CODE OF CONDUCT

You agree not to use the Service to post or transmit any User-Generated Media or engage in any activity that:

• Is illegal, or promotes or encourages illegal activity.
• Is hateful, discriminatory, defamatory, abusive, harassing, threatening, or otherwise objectionable.
• Is pornographic, obscene, or sexually explicit.
• Depicts or promotes violence.
• Infringes upon or violates the intellectual property rights (including copyrights and trademarks), privacy rights, publicity rights, or any other rights of any third party.
• Contains viruses, trojan horses, worms, time bombs, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.

We reserve the right, but are not obligated, to monitor, review, and remove any User-Generated Media that violates these Terms or is otherwise objectionable, in our sole discretion.

4. REPORTING AND CONTENT REMOVAL

We provide an in-app "Report / Remove" tool and an email route (privacy@joinourday.app) for users to request the deletion of specific User-Generated Media they believe violates these Terms, infringes their rights, or which they otherwise wish to have removed. We aim to review and act upon such requests within 48 hours where reasonably practicable. However, we are not obligated to remove content unless required by applicable law or if we determine, in our sole discretion, that it violates these Terms.

5. INTELLECTUAL PROPERTY

The Service and its original content (excluding User-Generated Media), features, and functionality are and will remain the exclusive property of JOINOURDAY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ and its licensors. The Service is protected by copyright, trademark, and other laws of both Poland and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of JOINOURDAY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ.

Other than the limited license granted to event organisers for User-Generated Media as described in Section 2.B, nothing in these Terms grants you a right or license to use any intellectual property owned or controlled by JOINOURDAY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ or its licensors.

6. THIRD-PARTY SERVICES

Our Service relies on Firebase services (Firebase Authentication, Cloud Firestore, Firebase Storage) provided by Google. Your use of these aspects of our Service is also subject to Google's applicable terms and policies. We are not responsible for the operation or policies of any third-party services.

7. TERMINATION

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or request account deletion as outlined in our Privacy Policy.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. DISCLAIMERS

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

JOINOURDAY DOES NOT WARRANT THAT A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

JOINOURDAY IS NOT RESPONSIBLE FOR ANY MISUSE OR UNAUTHORISED REDISTRIBUTION OF USER-GENERATED MEDIA BY EVENT ORGANISERS, GUESTS, OR ANY OTHER THIRD PARTIES. ONCE MEDIA IS SHARED WITHIN AN EVENT OR DOWNLOADED BY AN ORGANISER, WE HAVE NO CONTROL OVER ITS SUBSEQUENT USE OR DISTRIBUTION.

9. LIMITATION OF LIABILITY

IN NO EVENT SHALL JOINOURDAY, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING USER-GENERATED MEDIA; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICE OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO FIFTY EUROS (EUR 50).

10. GOVERNING LAW AND VENUE

These Terms shall be governed and construed in accordance with the laws of Poland, European Union, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the competent courts located in Rzeszów, Poland.

11. CHANGES TO TERMS & CONDITIONS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
